Capes acts solely as a technology platform and does not act as a merchant, reseller, payment processor, or intermediary in transactions between creators and buyers.
2. License & Usage Rights
By using Capes or services associated with it, you agree to the following:
Single User License
The license is valid for one single user only.
No Resale
You are strictly prohibited from reselling, redistributing, or sub-licensing your user credentials to third parties.
3. Payment Terms
For Creators
All prices listed on the website are in US Dollar (USD) or Indian Rupees (INR). Payments must be made in full before the delivery of any digital product. We reserve the right to change pricing at any time without prior notice.
For Users
- Capes does NOT process, collect, hold, or distribute payments.
- Direct creator-to-buyer payments.
- Third-party payment providers only.
- No financial control by Capes.
- No monitoring of transactions.
Because Capes does not participate in payments, we are not responsible for refunds, disputes, chargebacks, or financial issues between buyers and creators.
4. Accounts & Eligibility
To use Capes, you must:
- Be at least 16 years old (or meet local digital age).
- Provide accurate and truthful information.
- Maintain security of account credentials.
5. Creator Responsibilities
Creators are solely responsible for:
- Product/Service accuracy.
- Delivery of purchased content.
- Providing customer support.
- Legal/Regulatory compliance.
6. Creator Pages
Users are responsible for the content and management of their creator pages. Capes provides the infrastructure but does not endorse or take responsibility for user-generated content.
7. Prohibited Activities
- Fraud or deceptive practices.
- Malware distribution.
- Illegal financial activity.
- Pyramid schemes.
- IP Infringement.
- Illegal content distribution.
8. Intellectual Property & Ownership
Capes is the sole owner and developer of the Intellectual Property (IP) for all software services on this platform. We certify that:
- All code is written in-house by our development team.
- We strictly DO NOT sell, distribute, or support third-party, nulled, cracked, or unauthorized software.
- We are compliant with international copyright laws and DMCA regulations.
9. Disclaimer
The service is provided "as is" and "as available" without any warranties of any kind. We do not guarantee that the service will be uninterrupted or error-free.
10. Limitation of Liability
Capes shall not be held liable for any direct, indirect, or consequential loss or damage arising out of the use of our software, including but not limited to loss of data or business interruption.
11. Support & Maintenance
We provide free technical support for all users signed up on our platform.
12. Governing Law
These terms shall be governed by and interpreted in accordance with the laws of India. Any disputes are subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
